Purse Snatching At Mall Parking Garage

An elderly woman was the victim of purse snatching at a Fort Lauderdale mall parking garage recently when two suspects grabbed her purse and knocked her to the ground. The victim was able to give a description of the car used by the suspects as they fled from the parking garage and police were able to apprehend the suspects and take them into custody. Both suspects now face charges for the purse snatching itself and one of them is also facing charges for battery on someone aged 65 or over.

Florida Law Against Purse Snatching

The law regarding purse snatching, or more specifically robbery by sudden snatching, is set forth in Florida Statute Section 812.131, which defines the crime as taking money or property from a person. Additionally, there is an element of intent, as the suspect must have intended to deprive their victim of the property either permanently or temporarily.  The victim must also have been aware of the act as it was taking place. It is not necessary for the suspect to have used any force beyond what was needed to take the property from the victim, and it is also not necessary for the victim to have put up any resistance or sustain any injury as a result of the crime. Classification of the crime depends upon whether any weapons were carried by the suspect at the time of the act; if no weapon was carried, the crime is classified as a felony of the third degree and if the suspect did carry a weapon, the crime will be classified as a felony of the second degree.

What’s Your Defense?

For one accused of the crime of robbery by sudden snatching, there may be certain pretrial and trial defenses available. In addition, another defense to this crime is the claim of right defense, which is available to the accused if they have a good faith belief that they are the owner of the property they took or that they are entitled to immediate possession of the property. A knowledgeable and experienced criminal defense attorney will be able to assess a case and determine whether to claim this defense as a part of responding to the charges or preparing your case defense. Because of the importance of a felony conviction and the impact it can have on a convicted criminal’s future, it is necessary for anyone accused of this type of crime to consult with an experienced criminal defense attorney from the start.
